HB 1399 Emergency Powers During a Declared Public Health Emergency (2025 Session)
Emergency Powers During a Declared Public Health Emergency: Revises requirements for declaration of public health emergency; provides exemptions for local municipalities; authorizes individual to refuse examination, testing, or treatment for specified reasons; prohibits such individual from being required to undergo examinations, testing, or treatment or to isolate at home or quarantine; provides requirements for at-home isolation or quarantine; prohibits public employees from knowingly & willfully taking actions that violate individual's constitutional rights during declared public health emergency; provides for disciplinary action & civil & criminal penalties; provides whistle-blower protections for public employees who report specified violations. Effective Date: July 1, 2025
