Summary
Mitigation: Revises entities to & purposes for which water quality enhancement credits may be sold; requires DEP & WMDs to authorize such sale & use; provides circumstances under which basins are considered to be credit-deficient; authorizes local governments with land in such basins to consider proposals from private-sector applicants to establish mitigation banks on such lands; requires specified agreements between local governments & applicants for mitigation banks; provides requirements for determining amount of credits awarded to such mitigation banks. Effective Date: July 1, 2024
