HB 859 Flood Damage Prevention (2023 Session)
Flood Damage Prevention: Provides specified maximum voluntary freeboard requirements for new construction & substantial improvements to existing construction; prohibits voluntary freeboard from being used in calculation of maximum allowable height for certain construction; authorizes local governments to adopt by ordinance minimum freeboard requirement or maximum voluntary freeboard that exceeds minimum requirements; requires Florida Building Commission to adopt by rule minimum freeboard requirements & to incorporate such requirements into next edition of FBC; requires commission to review freeboard requirements every 5 years. Effective Date: July 1, 2023
