HB 459 Declarations of a Public Health Emergency (2024 Session)
Declarations of a Public Health Emergency: Provides that administration of vaccines is not included within meaning of terms “treat,” “treated,” or “treatment” as they relate to public health emergencies; revises provisions related to expiration & renewal of declarations of public health emergency; authorizes individual to refuse examination, testing, or treatment under State Health Officer’s order during public health emergency by submitting written refusal to State Health Officer; requires due process on case-by-case basis to allow actions that affect entire groups or communities. Effective Date: July 1, 2024
