HB 743 Mobile Homes (2016 Session)
Mobile Homes: Revises certain notice requirements for written complaints; requires adoption of rules relating to board member training for mobile home park homeowners' associations; authorizes mobile home park owner to pass on non-ad valorem assessments to tenant; provides that mobile home park owner is deemed to have disclosed passing on of certain taxes & assessments; requires non-ad valorem assessments to be part of lot rental amount; requires that renewed rental agreement remain under same terms unless certain notice is provided; authorizes mobile home purchaser to cancel or rescind contract to purchase; revises rights that mobile home owners exercise if they form an association; authorizes mobile home owners to become members upon incorporation of association; deletes provisions relating to memberships of successors to home owners; clarifying when association becomes representative of all mobile home owners; specifies voting requirements for homeowners' associations; authorizes members to vote by secret ballot & absentee ballot; prohibits tape recording or videotaping of certain meetings; delays applicability of certain board member training requirements; specifies future date after which directors who fail to comply with training requirements are deemed to commit violation. Effective Date: July 1, 2016
