HB 467 Sentencing in Capital Felonies (2014 Session)
Sentencing in Capital Felonies: Requires that advisory sentence of death be made by unanimous recommendation of jury after defendant's conviction or adjudication of guilt; requires court to instruct jury that, in order for jury to recommend to court that death penalty be imposed, jury must find that sufficient aggravating circumstances exist which outweigh any mitigating circumstances; requires court to instruct jury that each aggravating circumstance must be proven beyond reasonable doubt by unanimous vote; requires that court provide special verdict form for each aggravating circumstance. Effective Date: July 1, 2014
